Thursday August 4, 2016

Mayor Ted Terry called the meeting to order at 7:30pm.

PRESENTATION/ ADMINISTRIVE BUSINESS:
C1)  Approve Council Minutes for 6/29/16 Special Call, 7/5/16 10am Special Call and 7/5/16 Council Meeting
Awet Eyasu made a motion to approve the Council minutes from the 6/29/16 Special Call, 7/5/16 10am Special Call and 7/5/16 Council Meeting. Beverly Burks seconded the motion. 
Discussion:  Dean Moore listed corrections for meetings minutes. 
Awet Eyasu amended his motion to approve the Council minutes from the 6/29/16 Special Call, 7/5/16 10am Special Call and 7/5/16 Council Meeting with requested changes.  Beverly Burks seconded. A vote was called and the motion carried (4, 0).
 
PUBLIC COMMENTS 
Ms. Dean recommended approving the smoking ordinance as written.
 
Ms. Clark, Clarkston Senior Connection, mentioned the ongoing membership drive and encouraged participation.
Bill Gamble, Strokers, addressed the detrimental impacts the proposed smoking ordinance would have on their business. He felt the ordinance would place an undue hardship on their business and he asked the council to reconsider adopting the ordinance.
Ms. Girma, CPAC, stated there is no evidence to support that business revenues are reduced by restricting smoking.

NEW BUSINESS
F1)  Community Ambassador Program Presentation 
Councilwoman Burks provided an overview of the program. 
 
F2)  Adopt Smoking Ordinance 
Council Williams advised that the Mayor had brought the smoking ordinance to the Council and the Public Safety and Legal Committee have held several meetings to discuss and draft an ordinance. The proposed ordinance provides for a prohibition of smoking at all indoor places, with the exception of private homes.  Councilman Williams discussed the grandfather clause for hookah shops and adult entertainment to allow continued smoking until December 2018. The ordinance requires a 30 foot distance for smokers outside of the business entrance.
 
Mario Williams made a motion to adopt the smoking ordinance. Dean Moore seconded.  A vote was called and the motion carried (4, 0). 
 
F3)  Ban the Box Ordinance
Councilman Williams discussed the national movement for Ban the Box which provides for removal of any previous criminal history from job applications.  He reported that they need to hold further discussion to determine the extent the City will require compliance with contract vendors. The Council will consider this issue at either the September or October Council meeting. Mayor Terry stated this would count as the first read of the ordinance.
 
F4)  Approve Clarkston Community Center Grant Request
Cindy Bowden provided a recap of her work session discussion regarding a funding request of $25,000 for the Community Center. 
Beverly Burks made a motion to deny the Community Center request.  Awet Eyasu seconded the motion.  
Discussion
Dean Moore stated the City is currently borrowing funds to cover the gap in tax revenue receipts and that it would not make fiscal sense to donate money that is essentially borrowed funds.
 
Beverly Burks stated the City has already set the 2016 budget to define expenditures and as good stewards of the City they must be mindful and do what is in the best interest of the City.  She said they need to look at how they can continue the relationship with the Community Center and consider other means to support them.
 
Mario Williams and Awet Eyasu echoed the support of the Community Center and mentioned the other requests the City has denied for funding concerns. The Council encouraged the residents to support the Community Center and they provided information on the upcoming fundraiser on September 10th. 
 
Mayor Terry called for the vote and (4, 0) the request for funding was denied.  
 
F5)  Refer Study to Evaluate the water & sewer infrastructure to focus on potential obstacles to smart development in the TC zoning area to the Housing & Infrastructure Committee. 
Councilman Moore stated the importance of reviewing of evaluating the elevation of the sewer lines as they relate to future development.  
 
Awet Eyasu made a motion to refer a study to evaluate the water & sewer infrastructure to focus on potential obstacles to smart development in the TC zoning area to the Housing & Infrastructure Committee.  Dean Moore seconded the motion.  A vote was called and the motion carried (4, 0). 
 
F6)  Refer Omega Cafe's sewage issues to the Housing & Infrastructure Committee.
Councilman Moore gave an overview of the prior issues with the locations sewer.  
Beverly Burks made a motion to Refer Omega Cafe's sewage issues to the Housing & Infrastructure Committee.   Mario Williams seconded the motion.  A vote was called and the motion carried (4, 0).

Beverly Burks- reported the Coffee with Charities next event will be held on August 10th. 
Awet Eyasu -reported on his meeting with a delegation from Harrar Ethiopia on July 28th.  
Dean Moore- thanked the Council for staying tough on the smoking ordinance. 
5)  Mayor’s Report
Mayor Terry reported on an Audubon Society grant award for $38,000. He commended the council for their work on items submitted to the committees. 
 
ADJOURNMENT: 
Awet Eyasu made a motion to adjourn the Council Meeting.  Mario Williams seconded the motion.  A vote was called and the motion carried (4, 0).
