CLARKSTON CITY COUNCIL SPECIAL SESSION

Vice-Mayor Dean Moore called the meeting to order at 6:40pm.
Roll Call: Vice-Mayor Dean Moore, Awet Eyasu, Jamie Carroll and Beverly Burks.
Absent: Mayor Ted Terry, Mario Williams
Late Arrival: Ahmed Hassan
 
NEW BUSINESS
Mr. Barker gave a general overview of this process is for the land acquisition for the Streetscapes project going down East Ponce, Norman Road and Rowland.  The City engaged the services of a right of way acquisition firm and they have assisted the city in acquiring the 53 parcels that are required to construct this project. The majority of the parcels are in public right of way so there is very little fee simple. The majority is easements for access but there are some “cost to cure” if driveways or parking are to be reconfigured. The Georgia Department of Transportation has very strict guidelines for the local government to access the fair market value and the impact of those changes and compensate the property owner accordingly. There are instances where the fair value cannot be agreed upon, then the government has the right of imminent domain to go thru a legal process to place the determination of the fair market value into the hands of a third party, a Judge. Mr. Barker discussed the various requirements for the legal process. There were originally seven properties that were not in agreement, but those have been reduced to the three on the agenda. As of today, all parties have agreed and signed but the Council will proceed with the condemnations on the agenda, to ensure that the project is not delayed and to meet the strict GDOT requirement. 
Beverly Burks questioned the size of the parcels.  Mr. Barker reported that as an example, the first parcel is .008 acres, so they are very small.
Debbie Gauffman questioned the addresses on the parcels.  Mr. Barker advised two are the businesses next to Records Galore and the third in on Norman road approximately 4 parcels from the Park. 
 
Mark Osbourne questioned the depth of the condemnations as relates to width of sidewalks.  Mr. Barker reported the sidewalks will be six feet wide and this will include relocating mailboxes and utility poles that are in the sidewalk currently. 
 
Joshua Lowery had a question on the retaining wall on this property. Mr. Barker advised they should have the conversation with the project manager and Acquisition consultant to address. 
Warren Hadlock had a question on the owner of the businesses and Mr. Barker confirmed they had different owners. 
 
B1)  Approve Resolution, Order and Declaration of Taking for acquisition of additional right of way and temporary easement in “Parcel 30” (Tax ID #18-097-10-054; Owner: Jack Gibson) needed for sidewalk improvements in connection with the Clarkston Streetscapes project.
 
Beverly Burks made a motion I move that we Adopt the attached Resolution, Order and Declaration of Taking for acquisition of additional right of way and temporary easement in "Parcel 30" (Tax ID #18-097-10-054; Owner: Jack Gibson) needed for sidewalk improvements in connection with the Clarkston Streetscape project: and to consider authorizing the Mayor to execute all necessary documents. Awet Eyasu seconded the motion.  A vote was called and the motion carried (5,0). 
 
B2) Approve Resolution, Order and Declaration of Taking for acquisition of additional right of way and temporary easement in “Parcel 31” (Tax ID #18-096-06-005; Owner:  Snodell Morris & D.C. Morris (deceased)) needed for sidewalk improvements in connection with the Clarkston Streetscapes project.
Vice Mayor Moore read the agenda item. The City Council had no questions on the item. 
 
Awet Eyasu made a motion to adopt the attached Resolution, Order and Declaration of Taking for acquisition of additional right of way and temporary easement in "Parcel 31" (Tax ID #18-096-06-005; Owner: Snodell Morris & D.C. Morris (deceased)) needed for sidewalk improvements in connection with the Clarkston Streetscape project; and to consider authorizing the Mayor to execute all necessary documents. Jamie Carroll seconded the motion. A vote was called and the motion carried (5, 0).
 
B3) Approve Resolution, Order and Declaration of Taking for acquisition of additional right of way and temporary easement in “Parcel 53” (Tax ID #18-096-13-030; Owner:  Floyd P. Lowry & Joshua D. Lowry) needed for sidewalk improvements in connection with the Clarkston Streetscapes project.
Vice Mayor Moore read the agenda item. No questions from the Council.  Mark Osborne addressed a concern about the retaining wall.  Joshua Lowery provided an explanation on the importance of the retaining wall. Mr. Barker advised there had been several discussion on the wall and it was his understanding that an agreement had been signed. Vice Mayor Moore explained the purpose of the Councils action and that he should continue his discussion with the City Manager and Mr. Lowery’s attorney. 
 
Beverly Burks made a motion to adopt the attached Resolution, Order, and Declaration of Taking for acquisition of additional right of way and temporary easement in "Parcel 53" (Tax ID #18-096-13-300; Owner: Floyd Pl Lowery & Joshua D. Lowery) needed for sidewalk improvements in connection with the Clarkston Streetscape project; and to consider authorizing the Mayor to execute all necessary documents. Awet Eyasu seconded the motion. Discussion.  Awet Eyasu commended the efforts of the City Manager to take this process from 53 parcels to the three on the agenda, with pending completed negotiations is impressive. He further stated the project will add great value to all those properties  A vote was called and the motion carried (5, 0).
 
Awet Eyasu made a motion to adjourn.  Beverly Burks seconded the motion.  A vote was called and the motion carried (5, 0).
